CREATOR PROGRAM TERMS FOR MINORS
These Creator Program Terms for Minors (the "Terms") are part of our General Creator Program Terms (General Creator Terms) and are a legally binding agreement between Aghanim Inc. ("Aghanim", "we", "us"), and participating creators ("Creator", "you").
As a Creator, you create thematic content (Content) on social media platforms, websites, and other digital environments ("Platforms"). The Creator Program (the Program) is our initiative made to reward you for bringing us customers who like your Content and buy Games from us.
By enrolling in the Program, Creators have the opportunity to earn a portion of the money we make when such customers buy Games from us.
1. Understanding These Terms. Relationship with General Creator Terms
These Terms contain specific provisions applicable to Creators below legal adult age in their country/region of residence. Please ask your parent or a legal guardian to read and review these Terms with you. Their participation might also be needed along the way when you are setting off to become a Creator Program member.
If these Terms do not cover something specifically or clash with the General Creator Terms, the General Creator Terms will be what you follow when working with Aghanim in the Program.
Important Note to Creators: Primarily, when participating in the Program, including when you submit an Application to join the Program, submit your Content, earn Rewards, or request Payouts, you are the person having a contractual relationship with Aghanim. We may require certain information or assistance from your parents or legal guardians, but that does not determine whether our contract is with them.
This is not a job. We encourage you to treat the Program as a way for us to show appreciation for your Content but not as a form of employment. We cannot wait to see your Content and share the profit it would bring to us with you but will not require you to make a certain amount of Content or spend a certain number of hours doing so. The time you spend in the Program or the amount of Content you submit to us will not affect your Rewards or Payouts. What matters is whether it generates purchases of our Games. We treat your well-being and development seriously and may limit the time you spend in the Program.
As a Creator, you are entitled to payment for your Content when our Users purchase Games from us after viewing your Content. For that not to be kept from you, we encourage you to get to know about the rules that apply to you getting paid in your country/region to the best ability. If you are in doubt about them, please reach out to us at legal@aghanim.com or ask your parents or legal guardians to review them with you.
Important Note to Parents and Legal Guardians: Please note that if you enter into these Terms, and/or receive any payments, and/or communicate any information under these Terms on your child's or ward's behalf, you are responsible for complying with all child labor laws or similar laws and regulations about children's involvement in entertainment services and content creation.
Aghanim Inc. encourages you to carefully review such laws’ requirements, in particular those on remitting or preserving the remuneration due to minors for their services. If you are a resident in the U.S. and receive any funds under these Terms on behalf of your child or ward, Aghanim Inc. may require written proof of setting aside and/or remitting your child's or ward's earnings from the Program or other written representations as per the laws of the state you reside in.Aghanim Inc. hereby disclaims all liability for your compliance or acquaintance with such laws and regulations as a parent or legal guardian of a minor.
Please note that the Program is not offered as a form of employment, Aghanim Inc. does not require any commitments from Creators regarding the amount of Content they produce, or the number of hours they spend creating the Content. The participation in the Program is voluntary and remuneration may become due only for the Attributed Qualified Purchases as defined in Section 7 of General Terms. Please also note that, when required by federal or state law or any applicable regulations, we may limit the time that minors spend participating in the Program.
2. Application
2.1. If you are interested in participating in the Program, you will need to provide us with the necessary information and materials as requested by us when you interact with our services ("Application").
2.2. Application Process
When you play a Game that is involved in our Program or otherwise interact with the Game and the persons who made it, you may specify to such Game that you would like to participate in our Program and provide your email address and examples of your Content.
The company who made the Game will then send us this information, and we will review it. If we accept you in the Program, we will send you an initial email with next steps to set up your account in the Program and your Creator Code and Creator Link.
Before we make any Payouts to you, we need some information and documents from you. You will receive your Creator Code and Link, and we will track how many Games were bought with them, but we cannot pay you without this information.
2.3. The Information and Documents We Will Need
The information on all necessary things will be provided in our initial email or on our website when you first start to interact with the Program. We will also need some documents from you and your parents. We encourage you to fill in the Application with them or let them know that you are about to do it and ask their advice.
Here is the list of things we will need from you:

your legal name (please avoid nicknames) and contact details (like home address and email).

your age to determine whether you can participate.

where you are from to determine what rules we should follow.

the platforms you publish your Content on and examples of your Content.

an ID of one of your parents (like a driver's license, social security card or a passport).

your bank details or your parents’ bank details to pay you when your Content generates purchases for us. These should have the name of the bank and the owner of the bank account. If you do not have a bank account, please provide the details of one of your parent's/legal guardian's bank accounts.

if you live in the U.S., a completed Form W-9 in your name but signed by your parents or legal guardians (ask your parents/legal guardians to complete and sign this document for you).

if you live outside the U.S., a completed Form W-8BEN in your name but signed by your parents (ask your parents/legal guardians to complete and sign this document for you).
2.4. Approval of Applications. We welcome your creative spirit and your wish to become our Creator. Only because you are not a legal adult, there are rules to this, and we may reject your Application at the start or sometime after you get a Creator Code and Creator Link. Again, this has nothing to do with you or the quality of your Content. We are equally fascinated by the works of all creators, but we also have to comply with a whole bunch of rules. Bummer, we know.
Before we approve your Application, us publishing these Terms or otherwise making them available by Aghanim shall be deemed as an invitation to participate in the Program and to get payment of any Rewards but not as a contract between us.
Important Note to Parents and Legal Guardians: When providing Form W-9 or Form W-8BEN, please make sure that it is in your child's/ward's name and is signed by you, regardless of whether you are entering into an Agreement on their behalf.
We require the ID of a parent or a legal guardian to ensure compliance with the applicable laws and ensure that the Payouts are remitted correctly. If your child does not have a bank account, please provide the bank account opened in your name. We reserve the right to request additional documents, including birth certificates, to ascertain your relationship with the Creator.
The submission of the Application will not automatically lead to the conclusion of the Agreement and is subject to Aghanim's approval and acceptance.
3. Our Rules
We celebrate all creators and their works. There are, however, some things we are not OK with. There is a detailed list of such things in Sections 3 and 4 of our General Creator Terms. Please make sure that you understand it, and, if possible, have your parents or legal guardians review them with you.
In a nutshell, we want you to:

dedicate at least some portion of your Content to our Games all in all, how would anyone want to purchase them without being told about them?

when participating in the Program, use only the Content that you have created yourself, that means no copying or republishing others’ Content.

respect the rules of the Platforms where you publish your Content, that means that you should be wary not to breaktheir rules.
We also want your Content not to:

have some inappropriate stuff like swear words, violence, nudity, or attempts to bully someone.
-
portray Aghanim badly.
-
have scams, viruses, or false statements in them.
-
mention sweepstakes, giveaways, lotteries, or any other form of gambling.
Again, this is to give you a general understanding of our rules. Sections 3 and 4 of our General Creator Terms apply in full, and please make note of them when participating in our Program.
4. How Can You Use Our Content. How We Will Use Your Content
Section 4 of our General Creator Terms says a lot about what you are permitted to do with our Content. Please have a parent or a legal guardian explain them to you if you have trouble understanding them.
Generally, we want you not to use our Content and Games which we may provide to you in ways we did not tell you to. For example, it is fine to have a Game cover that we gave you in your social media post or to mention our name, but it will not be OK to alter any Content we gave you or publish it without giving us and our Games credit. It will equally not be OK to merge our Games or Content with unrelated content or rework our Content or Games without our permission.
Section 6 of our General Creator Terms grants us permission to use your Content in different ways. While we will not be selling it, we might use it in our social media or in our websites and systems to promote the Games. Where your Content has your image, you consent to us using that as well as part of your Content.
5. Rewards and Payouts
5.1. How Rewards Work. Sections 7 and 8 of our General Creator Terms explain how our Rewards work and how you get a Payout from them.
Here is a summary: Once we approve your Application, you will get a Creator Code and a Creator Link. You should include those in your Content as they allow us to track if the person who viewed your Content purchases with us. After that, the Users of our Games who viewed your Content might follow the Creator Link or use your Creator Code to buy Games from us. We will then share a portion of what they paid us with you.
Not all purchases made with the Creator Code and Creator Link will count towards a Reward to you. We determine what such purchases are and call the Qualified Purchases. Once a Qualified Purchase is made, we set aside a portion of that money to make a Payout to you.
We determine what that portion is. That depends on many factors like the Games’ popularity or price or the terms of the campaign we are running. We will communicate you the size of your Reward in your account with us or otherwise.
Please note that we will not be able to make Payouts if you do not provide us with the Form W-9 or Form W-8BEN and the bank account details.
5.2. Important Note to Parents and Legal Guardians: Any tax obligations that arise from the payment of Reward to the Creator lie with the Creator and/or their parents or legal guardians. It is your obligation to determine and pay the applicable taxes. We will not act as a tax agent or otherwise remit or withhold taxes from the Rewards or Payouts.
5.3. Payout Request. Please note that you can only make a Payout request to us once your Rewards balance reaches USD 100 ("Payout Minimum"). You can request a Rewards Payout through your Account in the Aghanim's Environment or otherwise in writing. We will make the payment within 10 calendar days of your request. It might take longer dependingon your location or your bank.
5.4. Payouts Refusal. Alternatives to Payouts. In some cases, we might not be able to make a Payout due to requirements of the applicable laws, problems with your bank, or the specifics of your location. This will not give you a right to demand the Payout as in such cases we will simply not be able to make it.
In such cases, we will work to provide you an alternative way to spend your Rewards, for example, as a discount to buy Games from us or to receive some other services. We have the final word in what that alternative shall be but will try to make it equal to the value of your Rewards recorded in your Account.
6. Miscellaneous
6.1. Where these Terms do not contradict our General Creator Terms or specify otherwise, our General Creator Terms will apply together with these Terms, including the definitions contained in General Creator Terms.
6.2. These Terms shall not be construed as an offer of employment or as a basis for guaranteed periodic payments. The Terms and the Program constitute a relationship between independent parties.
6.3. Aghanim will not assume any obligations of parents or legal guardians regarding the payments made to Creators under the legal adult age in their country/region of residence or reporting associated with such payments.
